Scott Sargent assaults Domino’s Tweed Heads manager over missing pizza

A Banora Point man drove to Domino’s and attacked the store manager when he believed one of the pizzas from his order was missing. But the move backfired on him.

A Banora Point man has avoided spending time behind bars after a violent attack on a Domino’s manager over claims a pizza was missing from his order.

Scott Sargent, 43, and his brother made a delivery order with Tweed Heads Domino’s on October 30, 2021, for two pizzas, two garlic breads and a soft drink, according to police facts.

At 8.26pm the order left the shop for delivery and at 8.50pm Sargent’s brother called the store to complain they didn’t get a third pizza he had paid for.

He was told they received what was paid for and if they wanted a third pizza it would be $15 to be delivered.

Sargent called the store and made threats to “come down and bash your head in” to the manager, Dion Ezzy, and to “rip his head off”.

Sargent arrived at the store holding a green wheel nut wrench spanner raised above his head yelling for Mr Ezzy to come outside at 9.12pm.

Mr Ezzy told Sargent he was on camera and he didn’t need to come outside.

Sargent then smashed the front counter with the wrench before throwing it at Mr Ezzy, hitting him in the stomach at one point.

The pair got in a scuffle where Sargent fell off the counter, onto the ground and pulled Mr Ezzy down with him.

Mr Ezzy gained his footing and dragged Sargent off the counter, pulling him up and his shirt off.

Sargent left the store before Mr Ezzy chased after him with the wrench.

Sargent pleaded guilty in Murwillumbah Local Court on Monday to going armed with intent to commit an indictable offence, carrying an offensive implement in a public place, affray, stalk or intimidate, destroy or damage property and common assault.

Defence lawyer Russell Baxter told the court Sargent was on “all fours throwing up questioning why he did such a stupid thing” once it was all over.

He said his client had a traumatic childhood and tried to keep out of trouble by working.

Mr Baxter said his client had also provided compensation to Domino’s for the damage.

“He’s grossly embarrassed,” Mr Baxter said.

Speaking after court proceedings, Mr Ezzy said he was more concerned for the 10 staff and one customer in the store who witnessed the incident.

He said one lady got trapped inside the corner of the shop.

He said staff brought her out the back and gave her water after Sargent left.

“I’ve been there 14 years, most of the time they threaten you on the phone and never turn up,” Mr Ezzy said.

“He took it a bit further and turned up.”

Mr Ezzy said a number of younger staff went home but were all taken care of by himself and the other store manager.

“All over a $5 pizza, it was definitely an over-reaction on his part,” Mr Ezzy said.

He said Sargent’s mother called the store the next day to apologise for his behaviour.

Sargent was convicted and sentenced to a 15 month intensive corrections order and a 12 month community corrections order.

The weapon was ordered to be forfeited to the crown.
