A man dealing with more than $379,000 alleged to be the proceeds of crime involving a superannuation company asked for the case to be dismissed. Here’s why.

A 51-year-old man accused of dealing with more than $379,000 in proceeds of crime has asked for the court to dismiss his case due to delays in proceedings.

Craig Campbell Davis faces two counts of dealing with proceeds of crime.

The matter was heard before Tweed Heads Local Court on Friday where his lawyer Kalina Ivanov asked for the case to be dismissed due to the time it had taken for the case to be certified.

As noted by Magistrate Peter Bugden, legislation states a matter should be dismissed if it takes more than six months for prosecution to certify charges unless it is not in the interest of justice to do so.

Crown prosecutor Dyllon Westendorf told the court it was identified some time ago as part of the matter that requisitions were needed from the superannuation company.

Mr Westendorf said the prosecution had contacted the company for updates on April 7 and May 9 and on those occasions they were still waiting on those documents to be compiled.

He told the court the case was a “serious sophisticated fraud” matter.

Mr Bugden noted the alleged money involved in the cases was above $259,443 and $119,648, making the matter a “significant” amount of money.

“That is a crucial factor the court has to take into account,” he said.

He said if it was a lesser amount of money he would have no hesitation dismissing the matter.

Mr Bugden refused the application and however made an order on the next occasion there would be no more adjournments.

The matter was adjourned to August 12.
