A Banora Point man has led police on a car chase when they approached him while he was using the services of a sex worker.
According to court documents Bodine Jack Dealey Muntz came to police attention on March 3 at 11.50pm when a member of the public stated she could hear whistling and see a car driving around suspiciously on Marinas Crescent and Old Ferry Road in Banora Point.
Police found the Toyota Hilux on Commodore Court and began to follow when Muntz accelerated up Old Ferry Road and onto Terranora Road.
Police activated warning devices signally for Muntz to pull over, which he failed to comply with.
He initially travelled the speed limit, crossing over to the wrong side of the road before travelling 80 in a 60 zone along a straight stretch.
Police remained behind the Hilux along Terranora Road before Muntz hit a winding section of the road, crossing to the wrong side on the bends as rain became heavier.
This caused police to terminate the pursuit.
Police attended Muntz’s address on March 5 where the Hilux was parked out the front.
When police interviewed him, he said he knew they had lights and sirens activated but didn’t pull over, stating he had “a brain snap”.
He denied being under the influence of drugs or alcohol.
When questioned why he was down by the river he said he was with a female sex worker in a secluded area and she had been in the car during the pursuit and had egged him on not to pull over.
Muntz pleaded guilty in Tweed Heads Local Court on Monday to engaging in a police pursuit.
His defence lawyer said the 28-year-old had been “caught in a moment with his pants down” and faced a fight or flight response, choosing flight.
He told the court in terms of crossing to the other side of the road, it was not uncommon for drivers to cross over to avoid water on the road.
He said the pressure cleaner had expressed his remorse and made full and frank admissions to police.
Police prosecutor Sergeant Alix Thom said although the situation was “slightly embarrassing” Mr Muntz had imposed obvious risk to other road users.
“Not every person would engage in police pursuit to avoid an embarrassing situation,” she said.
Magistrate Geoff Dunlevy said Muntz had acted “highly irresponsibly”.
“You being in a car with a sex worker is no different to being in a car with someone else you’re engaging consensual sexual activity with,” Mr Dunlevy said.
He convicted and sentenced Muntz to a two year community correction order and disqualified him from driving for 12 months.
