A NSW North Coast woman who allegedly broke into her mother’s house then assaulted her – leaving her with “real fears” – has been charged.

An unemployed North Coast woman who allegedly broke into her mother’s house, assaulted her, and scratched a door with a shoe, has faced court.

Monique Marshall, 28, fronted Ballina Local Court on Thursday on charges of aggravated break and enter, domestic violence related common assault, intentionally damaging property and trespassing.

Court documents state that Marshall allegedly broke into her mother’s Lennox Head home through the back window on July 11 between 12.10am and 12.28am, knowing the woman was home.

Police will allege Marshall then assaulted her mother, and then intentionally scratched a door with a shoe before being arrested.

The Ocean Shores woman spent a night in custody on remand after having her bail refused by police on the grounds that “this is quite (a) serious (domestic violence) matter, allegedly unprovoked, by (the) daughter upon (her) mother”.

“This is a continued DV situation evolving around her mother from Lennox Head,” police facts allege.

“Police and the victim have real fears that if the accused is allowed at large short-term, she will continue to reoffend.”

At Marshall’s bail application before Byron Bay Local Court on July 12, magistrate Karen Stafford agreed there was a strong prosecution case against Marshall, though she considered Marshall was unlikely to face a custodial sentence if convicted.

A police bail consideration document tendered to the court alleges the accused is understood to have a drug problem which impacts her mental health.

Marshall was granted bail by Ms Stafford on the condition that she was not to go near or contact the complainant or prosecution witnesses.

She is not to drink any alcohol or use any drugs unless prescribed by a doctor and to stay at her Cooroibah address with her partner.

Marshall is also required to accept any treatment reasonably recommended by a GP.

Marshall faces charges of intentionally or recklessly destroying or damaging property, aggravated break and enter while committing a serious indictable offence, common assault and unlawfully entering enclosed lands.

Ms Stafford adjourned the matter to October 26 for charge certification before Lismore Local Court.

No pleas have been entered yet.
