A man who got behind the wheel after he sunk three stubbies of Tooheys was hostile to police when he was apprehended, a court has heard.

Luke Sims, 43, was driving on Minjungbal Drive, Tweed Heads South, when he was asked to pull over for a random breath test.

Court documents state Sims was immediately hostile towards police and completed a breath test returning a positive result of 0.99, almost twice the legal limit.

Police facts state when Sims was arrested, he was agitated - yelling and swearing at police and punching inside the vehicle.

Sims then dropped to the ground, refusing to walk - with two escorting police all ending up on the ground.

Sims was convicted and sentenced to a community corrections order for 12 months at Tweed Heads Local Court on September 19 and must have an interlock device installed on his car.

The court heard Sims wasn’t thinking straight as he had his mother‘s funeral the next morning and his battle with bipolar disorder made it difficult for him to keep working.

“I’m deeply remorseful for the stupid actions I’ve done, and I shouldn’t have spoken in that matter to Tweed Heads police,” Sims said.

Magistrate Geoff Dunlevy cautioned Sims that his reading of 0.99 was almost twice the legal limit and was a significant risk to himself and others.

“I will have to record a conviction against your name - living with a significant mental health issue perhaps has contributed to what happened, which somewhat lowers your cognitive ability,” Mr Dunlevy said.
