Prosecutors failed to notice that a smash repair boss who offered up $1 million cash bail for a man accused of killing notorious bikie Mick Hawi had recently spent a night behind bars himself.
The embarrassing stuff-up yesterday prompted the Office of the Director of Public Prosecutions to seek to have the bail for panel beater Jamal Eljaidi revoked because his benefactor Bradd Ring was facing charges of possessing motorbikes suspected of having been stolen.
Ring, 46, a martial arts expert and former boss of his family’s smash repairs company, was in police custody for one night after he was stopped in Ramsgate on August 12 and charged with possessing two stolen motorcycles and a moped. He was granted bail the next morning in Sutherland Local Court.
“In relation to Jamal Eljaidi’s bail application, the matters raised were not disclosed to the court at the time,” a Supreme Court spokeswoman said yesterday. “Nor were any objections raised by the Crown.”
Legal sources yesterday said prosecutors were required to liaise with detectives in charge of the case to see if they had problems with the person putting up bail but “the system is so overburdened that often there are no resources to make checks and decisions are having to be made at the last minute”.
Attorney-General Mark Speakman said he understood “community concerns” and had sought further advice from his department.
Hawi, boss of the Comanchero bikie gang, was shot dead outside Fitness First in Rockdale last year. Eljaidi is one of four men charged over his murder and police allege he was the getaway driver.
Last week the Supreme Court granted Eljaidi bail after being told that Ring had agreed to deposit $1 million and forfeit the sum if bail was breached. But with criminal charges hanging over him, the prosecution will now argue he is not an “acceptable” person under the law to post bail.
The Daily Telegraph yesterday revealed that Ring was arrested again at 1am on Sunday by police who allegedly found weapons and ice in his white Hino truck.
He will appear at Burwood Court tomorrow. Eljaidi remains in Silverwater Jail on remand with his bail conditions not being met.
