Five-time lottery winner Carlo Massetti claims he can’t afford a psychiatric report as he seeks to get domestic violence charges dropped on mental health grounds.

The 48-year-old multi-millionaire arrived at his Waverley Local Court hearing on Tuesday, hand-in-hand with the woman he’s accused of assaulting.

Massetti allegedly attacked Danielle Prebble just days after hitting the jackpot for the fifth time last June.

But the former undertaker’s lawyer said he needs to help Massetti stump up cash for a psychiatric assessment before he’s expected to apply for the case to be dismissed on mental health grounds next month.

“At the moment he’s living with his father and has no source of income,” John Walsh said.

Since 2012, the philanthropist has won five first division Lotto prizes and hasn’t worked, while his elderly dad moved into his luxury Bondi Beach apartment as part of his bail conditions.

Massetti was thrown in jail again in November following another alleged incident with his girlfriend and was hospitalised upon release on bail in December, the court heard.

Since then he’s been on a “very strong psychiatric treatment program” after doctors discovered he was on too small a dosage of the wrong medicine, Mr Walsh said.

“The world seems to have come much better,” he said.

Massetti has pleaded not guilty to three counts each of domestic violence-linked common assault and contravening apprehended domestic violence orders.

The ex-funeral director is also fighting a stalking charge and a domestic violence-linked assault causing actual bodily harm.

On May 7 he won Lotto’s $1 million division-one prize and five days later picked up another $1.5 million. Then within two weeks Massetti scored $4000 in a Powerball draw.

According to court documents, he made “domestic violence related calls” between 7.30pm and 9.30pm on June 14 and was charged with assault four days later.

Later that month Massetti and Ms Pebble visited a couples counsellor together before getting drunk at the Australian 18 Footers League waterfront club in Double Bay, police allege.

The pair shared 15 Jack Daniels and Cokes while playing the pokies until closing time, then they returned to their room at the nearby Intercontinental Hotel to continue drinking.

They soon got into a verbal fight about Ms Pebble’s then 11-year-old daughter before Massetti allegedly threw her mobile phone into a toilet.

“Around this time the victim began throwing up,” police facts state.

“The victim was well intoxicated at this time and recalls the accused splashing water on her face, however believes the accused was doing this to help her.”

Cops and an ambulance were called but Massetti allegedly fled the scene before they arrived.

Ms Pebble fished her phone from the toilet bowl undamaged before being taken to St Vincent’s Hospital and two days later Massetti fronted Waverley Police Station where he was arrested.

Police allege Massetti also assaulted Ms Prebble in the early hours of July 29 at Bondi Beach while another more serious assault with stalking occurred before 7am on November 24 at South Coogee.

Massetti told The Daily Telegraph in June that he had recently been divorced and was currently in a “complicated relationship”.

That month he donated $50,000 to St Vincent’s Hospital’s cardiac services after both his father and two grandparents had suffered multiple heart attacks.
