A meth-fuelled Richmond Valley man has been put behind bars for trying to stab a former police officer with a large shard of glass during a group attack.
Tyreece Gomes, 21, was sentenced to prison on Wednesday for damaging property, two counts of intimidation, affray and failing to appear in accordance with bail acknowledgment.
Gomes appeared at Lismore Local Court through an audiovisual link from custody.
The 76-year-old victim, a former police officer of 30 years, took to the stand to give evidence in court.
He heard smashing sounds outside his Lismore home about 2.30am in February last year and went to inspect it, the court heard.
The former officer saw some windows on his caravan, parked outside his home, had been smashed.
He told the court a group of four people – three men and one woman – came out of a side street and began to run towards him while he was calling the police.
“They started to yell at me and fight me. Gomes said, ‘I’ll kill you, you old dog’,” he told the court.
“Gomes threw a 20cm plane of glass to try to stab me with it,” the victim said.
“I was fighting all three, they were trying to fight me.”
Defence lawyer Guy Draper said the attack happened after Gomes went on a binge of methamphetamine (ice) when he had a “chaotic frame of mind”.
“Gome was injured when he threw the glass to his own misfortune,” he said.
“He had a difficult childhood, he will be staying off drugs to live a normal life.
“Gome has demonstrated insight into his offending and genuinely understands there is no excuse for his behaviour,” he said.
Magistrate Michael Dakin said the witness’ evidence was very impressive.
“When the victim tried to record the attack, he was punched and his phone was taken,” he said.
“Gomes intentionally or recklessly ruined a property.”
Mr Dakin sentenced him to two years in jail with a non-parole period of 15 months. A conviction has been recorded.
