Tweed man jailed for DV sex assault in Lismore District Court

A Tweed man has been jailed over a cruel and prolonged act of domestic violence which left his partner barely able to walk.

A Tweed man has been condemned over a savage act of domestic violence and sexual assault which left his partner barely able to walk.

The 38-year-old man, who cannot be named to protect the victim, was sentenced in Lismore District Court on Friday for two counts of assault occasioning actual bodily harm and aggravated sexual assault, relating to events from March 1 and 3, 2020.

The court was told the man was living with his partner when he became increasingly paranoid she was cheating on him.

The paranoia reached breaking point when the man approached the woman, aged in her 20s, for anal sex on March 1.

When she said no, he smacked her a number of times, telling her “you’re my woman and I should be able to do whatever I want to do with you”.

Two days later, the man had been smoking meth when he attacked his partner again in a “vile” abuse episode that lasted between four to six and a half hours.

The court was told the man began by punching his partner repeatedly, giving, what she alleged, was only 30 second periods of reprieve.

When she couldn’t handle the abuse any longer, she curled into a ball of pain but he continued to jump on her.

Judge Jeffrey McLennan said the man told his victim who tried to scream to “shut up or I’ll break your jaw in”.

The man slammed his leg into her throat and she was unable to breath.

He picked up a broken table leg and hit her.

After that, he began threatening her with a large knife.

“I haven’t decided which end I’ll shove up you first,” the court heard the man told his terrified partner.

He forced her to perform fellatio, an act in which she was crying the whole time.

Later that morning, the man took his partner to a friend’s house who said the victim was barely able to walk and was dribbling at the mouth.

An examination at Tweed Heads hospital revealed extensive injuries which included a perforated eardrum.

Judge McLennan said when police arrested the man he told them he was “off my head with ice” and later told psychologists he had been using so much he hadn’t slept for four nights prior.

Judge McLennan said the woman’s “extensive catalogue of injuries” was unacceptable.

“As the facts reveal, the offender has a clear sense of entitlement,” he said.

“This is a gross level of domestic violence which needs to be the subject of denunciation and punishment.”

He took into account submissions about man’s upbringing which involved witnessing DV in his household as a child.

However, Judge McLennan said it was more likely than not, the man would reoffend in such a violent way towards women.

He sentenced the man to 9 years and 6 months in jail, backdated to March 4, 2020 and expiring on September 3, 2029

He will be eligible for parole on September 3, 2026.
