Sentencing looms for Kyogle man, 40, convicted of sexual intercourse without consent

The 40-year-old Kyogle man was arrested after a five-month police investigation, and has since been convicted of two counts of sexual intercourse without consent.

A sentencing date has been set for a convicted Kyogle rapist, found guilty of two counts of sexual intercourse without consent.

Gregory James Agnew, 40, had pleaded not guilty to two charges of sexual intercourse without consent during a Lismore District Court trial in June, but was convicted on both counts.

Police revealed Agnew had committed the crime in November 2018.

He was later arrested in May 2020 after a five-month police investigation into several alleged drug and sexual assault incidents within the Richmond Police District.

During his Tuesday Lismore District Court proceedings, Agnew’s barrister Megan Cusak said the defence party was ready to proceed with the sentence.

Charges on a 166 certificate, including stalking or intimidating intending to cause fear physical or personal harm and supplying a prohibited drug, were also ready to proceed, according to Ms Cusak.

However, she noted the supplying drugs charge was “intrinsically linked” to the rape charges, with a deal of evidence in that charge given in trial proceedings.

Given that, Judge Jeffrey McLennan marked a sentence date for the two counts of sexual intercourse without consent on August 26.

He will be sentenced over the supplying drugs charge in Lismore District Court on July 2, and the stalking/intimidation charge will be heard before Lismore Local Court on June 21 for further committal mention.

Mr Agnew has made no application for bail and bail was was refused.
