Man who allegedly caused partner to haemorrhage out on bail due to court bungle

Despite it being an “extremely serious” case, a court bungle and months of ongoing delays have led to this Northern Rivers man being let out of prison on bail.

A man who allegedly left his partner in a “comatose state” has been let out on bail, due to a stall in court proceedings.

At Lismore Local Court on Wednesday, the court heard the Northern Rivers man, who cannot be named, was appearing in regards to serious domestic violence allegations.

According to the DPP prosecutor, the victim allegedly suffered “extensive injuries” and arrived at hospital in a “comatose state” and “haemorrhaging”.

Despite that, the court heard the matter had barely progressed since the man’s custody arrest in early March.

The man’s solicitor James Fuggle said the Department of Public Prosecutions had multiple times extended the charge certification date, leaving the matter “months overdue”.

“I made inquiries last week in respect of the matter to find out the solicitor had been on leave for two weeks,” he said.

Due to the delay, Mr Fuggle asked Magistrate Jeff Linden that his client be given “immediate release”.

In their submission against bail conditions, the DPP prosecutor argued bail left the man “at risk of endangering the community and interfering with witnesses”.

“I submit in the interest of justice, the matter not be dismissed today,” she said.

“These are extremely serious charges.”

The DPP prosecutor stated there was a “degree of complications” in the matter with the medical evidence “very complex” which had contributed to the delay.

But Mr Fuggle argued the “crown case as not as strong as the crown would let it appear”.

“In all due respect, my client is sitting in prison,” Mr Fuggle said.

“(The DPP have had) two extensions and they’ve failed to do anything of any meaning or communicate to me.

“The interest of justice is a two-way street.”

Given the DPP failed to failed to serve a charge certificate before six months, Mr Linden granted bail to the man.

The case will next appear before Lismore Local Court on May 26 for further mention.
