Kyogle man will head to Lismore District Court trial following alleged rape

A Kyogle man will head to trial after entering pleas regarding the alleged act of horrific domestic violence.

A Northern Rivers man will head to trial after entering pleas regarding an alleged act of horrific domestic violence and rape.

The Kyogle man, who cannot be named for legal reasons, was formally arraigned in Lismore District Court on Monday, August 30.

He pleaded not guilty to aggravated sexual intercourse without consent and causing grievous bodily harm being reckless as to cause actual bodily harm.

The court heard the event allegedly took place on September 2, 2020 in the Lismore region.

The Department of Public Prosecutions previously said they would allege the man’s partner suffered “extensive injuries” and arrived at hospital in a “comatose state” and “haemorrhaging”.

It is understood the man called an ambulance following the alleged event and upon medical referral, the case was taken up by police.

DPP prosecutors also previously mentioned medical evidence in the case was “very complex”.

On Monday, DPP prosecutor Sarah Wilkin said a case conference had been held and some “pre-trial issues” may be resolved before the trial date.

The man’s solicitor James Fuggle said it was expected the trial would last between five and seven days.

Judge Jeffrey McLennan set a trial date for March 2022 with an exact date to be confirmed later.

The Kyogle man will remain on bail until that date.
