A North Coast man found guilty of raping a woman who first thought she was having sex with her boyfriend has now been sentenced to five years jail.

Jayden Davis, 26, of Casino was found guilty by a jury on February 2 of having sexual intercourse without consent at a Casino home about 12.40am on February 6, 2021.

The victim was attacked in the dark and believed her boyfriend was the man kissing her, but soon realised it was Davis, the court was told.

“I got woken up by someone over the top of me kissing me,” she said.

“I was half asleep not realising who was on top of me, he pulled my pants down and tried to put it in me.”

The woman in her early 20s told the court Davis “ripped out” a tampon and penetrated her while she was high after smoking cannabis.

She noticed Davis’ facial hair and “a growing awareness dawned” it was not her partner.

Davis admitted to having sex with the woman and the court heard his DNA was found inside her because he did not use a condom.

Davis, who claimed innocence, sent texts after his offending: “I was drunk and in the mood, so I thought f--k it.”

“She was awake and knew what was going on. She opened her legs and we had sex,” he wrote.

“She can’t try rape, that chick was all for it.”

Davis was described as “reckless” by the prosecutor because he assumed the woman’s consent and “took no steps whatsoever” to see if she was alright.

The victim told the jury: “He should have said something to me but he didn’t.”

The court heard medical conditions, including a bullet in Davis’ body, were being considered before sentencing.

On Thursday at Lismore District Court, Judge Jennifer English handed down the five year term, backdated to June 15 last year.

Davis, who did not have to appear, spent time behind bars on remand.

He will be eligible for parole on June 14, 2025.
