Bradley Presbury convicted of fatal brawl assault back in court for steroids related to case

The 23-year-old was convicted and sentenced over a 2018 fatal Ballina brawl, but further matters relating to the case were dealt with in court this week.

A man convicted and sentenced over a 2018 Ballina fatal brawl has appeared in court again for matters relating to the incident.

Bradley Presbury, 23, was convicted on June 24 for assault occasioning actual bodily harm in Lismore District Court for an event resulting in the death of Iluka man Aaron Marks.

He was also convicted for supplying a small quantity of a prohibited drug and perverting the course of justice.

He was sentenced to a backdated aggregated 501 days imprisonment, expiring on June 23, 2021, which meant Presbury could walk free that afternoon.

However, Presbury matter’s were heard again in Lismore District Court on Monday, August 2.

The court heard during the June sentence two charges on a 166 Certificate were not dealt with at the time.

They were possessing a prescribed restricted substance and goods in custody believed to have been unlawfully obtained.

The Crown Prosecutor explained the charges related to police finding a bottle of testosterone during a police raid at Presbury’s address.

He added only one charge needed to be dealt with as the other was a back-up charge.

Given that, the goods in custody charge was withdrawn.

Presbury’s solicitor Megan Cusack said he would not appear in person but enter a guilty plea for the charge on his behalf.

Judge Jeffery McLennan convicted Presbury with no further penalty.
