Accused Casino car thief to remain in custody, court hears he will apply for bail next time

The court heard the 29-year-old man, who was allegedly caught by Casino residents, is facing five charges, and he did not apply for bail.

A Northern Rivers man who police allege was caught trying to break into cars overnight has fronted court.

Daniel Avery, 29, appeared before Lismore Local Court on Wednesday via custody link, facing five charges including larceny, custody of a knife in a public place, resisting a police officer in the execution of duty, good in personal custody believed to be stolen, and committing a S114 offence, having a previous conviction.

According to reports from Richmond Police District, about 3am on Wednesday morning, Police attached to Casino General Duties responded to calls from members of the public in relation to an alleged offender attempting to break into motor vehicles in Johnson St, Casino.

Mr Avery was subsequently arrested after a short foot pursuit with police.

During his court appearance, the man’s duty lawyer Kim Louise Ivosevac said he would not apply for bail.

She indicated he would apply for bail at his next appearance.

The police prosecutor requested the case be adjourned for a brief service mention.

“These are Casino matters but I’m happy for them to stay here,” he added.

Magistrate Jeff Linden obliged, noting that a formal plea “must be entered” on the next occasion.

He adjourned the matters for August 25.
