Nimbin man sentenced over sharing images of ex

A Nimbin man who left terrifying threats to his former partners, including a voicemail that told them he would slit their throats for “f***ing (him) over” has learned his fate.

A Nimbin man who subjected his former partners to a horrible “litany” of abusive calls and spread their intimate pictures will spend time behind bars for the act.

The 34-year-old, who cannot be named to protect his victims, appeared before Lismore Local Court pleading guilty to two charges of contravening an apprehended violence order, two charges of using a carriage service to harass, intentionally distributing an intimate image without consent and two charges of stalking and intimidation and a possessing a prohibited drug charge.

The man’s solicitor Paul Smart said the dad of four had been drinking throughout an evening dinner and while he attended a drum circle before leaving for his home and consuming more alcohol.

This left him almost “inebriated” on April 1st of this year.

It was at that stage “jealousy overtook him” said Mr Smart.

The court documents reveal the 34-year-old sent a number of 11 messages, eight missed calls and several voicemails to his two former partners, including a voicemail in which he said “I’m gonna slit her f***ing throat for f***ing me over and slit your throat next c***” and telling both ex-partners they were “f***ing dead”.

Mr Smart said this jealousy stemmed from finding the former partner in bed with someone else.

“That ignited a lot of jealousy and a lot of reaction,” he said.

On January 16, the man was sentenced to an Intensive Corrections Order for related domestic violence charges.

He was arrested on April 2 after the women contacted police where police also spied the 8g of cannabis in plain sight, court documents state.

Mr Smart said his client had tried to get those feelings of anger under control by moving to Nimbin after that sentence to help his mother run her Airbnb and “basically turned his life around.”

The Nimbin man had spent 44 days in custody, and subsequently grown embarrassed by how “stupid this offending was” said Mr Smart.

“(The threats were) hollow dribble even though very serious on the face of them,” he said.

“He had no intention to travel from Nimbin to Wyong. ”

Mr Smart noted the man’s difficult childhood and other factors before acknowledging there were “no excuses” for the “terrible comments, terrible threats” made.

Magistrate Jeff Linden described the exchanges as a “litany” of abusive contact.

“It involved sending images of his former partner’s breasts, involves outrageous comments and more importantly serious threats,” he said.

He said the man’s alcohol abuse was not an excuse although it may be a reason.

Magistrate Linden convicted the man on all counts.

For the two charges of contravening an apprehended violence order, two charges of using a carriage service to harass, intentionally distribute an intimate image without consent and two charges of stalk and intimidate Magistrate Linden sentenced Gram to a 20 month jail term, backdated to April 1 with a four month non-parole period.

For the possess a prohibited drug charge, he was convicted but without further punishment.
