Chad Ashtly Davis sentenced at Ballina court on assault charge

A concreter who got into an argument with a mate after a Boxing Day barbecue at Evans Head has faced court. Read how the event escalated after heated text messages and a refusal to share cannabis.

A man’s refusal to share some weed and a running text message exchange that escalated into a physical fight at Evans Head just after Christmas has played out in court.

Pottsville concreter Chad Ashtly Davis, 44, pleaded guilty to assault occasioning actual bodily harm and enter building/land with intent to commit indictable offence when he appeared at Ballina Local Court on October 21.

Police facts state Davis, Tyson Tarver and a third man partied overnight at a Boxing Day barbecue and at noon on December 27 drove to Tarver’s house.

There, Davis was asked to share some of his cannabis with Mr Tarver. Davis refused and moved the car four houses along the street.

Police facts stated Mr Tarver taunted Davis, yelling he was ‘stupid for parking the car there’ and that he was going to ‘flog him’ and destroy Davis’ car.

Mr Tarver followed Davis to the nearby address, but left after he realised the front door was locked.

Davis sent a text message to a mutual friend: “Tell Tyson I’m gunna stand on him”, police facts state.

Within a short time Mr Tarver replied: “Come and see what happens.”

Davis then got out of bed and went to Mr Tarver’s house, passing the mutual friend on the footpath.

Police facts state Davis found the front door open, knocked on the door frame, and yelled: “Where are you?”

When Mr Tarver answered he was in the kitchen, Davis entered the house and said “I am here now, what are you going to do?”.

Police facts state Mr Tarver pushed and punched Davis, who retaliated, and a physical altercation ensued.

The fight stopped shortly after, court documents revealed, with Davis calling Mr Tarver a ‘dog’ as he left the premises.

Mr Tarver then called police. He suffered scratches and abrasions on his cheeks, and scratches on his back and left ear. Mr Tarver faces no charges in relation to the incident.

When officers arrived they found Davis next to a motor vehicle.

He had blood running from his nose and other cuts and abrasions on his face and body, and was in the process of cleaning himself with a towel.

Police detained Davis for medical treatment before arresting him and escorting him to Ballina Police station where he was charged.

Davis was convicted and sentenced to an 18-month community correction order and fined $1000.
