Samuel Macqueen: Yamba man sentenced for high-range drink-driving

A North Coast business owner who was busted driving more than three times over the legal limit was warned “it only takes a moment for terrible things to happen” by a magistrate.

The owner of a Clarence construction business was busted driving more than three times over the legal limit after he fled from “a physical altercation” at a popular bar.

Yamba man Samuel Macqueen, 30, fronted Maclean Local Court after pleading guilty to high-range drink-driving.

In the early hours of July 23, Macqueen became involved “in a physical altercation” at Yamba’s Last Rites Bar, according to court documents.

He later told police he decided to drive because he was trying to “get away from” other people involved in the altercation, a court heard.

On the night of the offence, his driving quickly caught the attention of police when they spotted a small truck near the Angourie Rd roundabout at 12.26am.

Court documents state Macqueen was driving faster than the 50km/h speed limit and had crossed unbroken dividing lines.

“When police approached the driver’s side of the truck … it was immediately apparent (Macqueen) was well affected by alcohol, he was slurring his words, movements were slowed and strong smell of alcohol could be smelt on (his) breath,” court documents state.

Macqueen was arrested and taken to the police station where he returned a reading of 0.157 — over three times the legal limit.

In court, Macqueen’s defence lawyer said his client was “deeply ashamed and embarrassed”.

The court heard he has a young family and runs a building company which employees up to five people.

The defence also said the 30-year-old gives back to his community through his involvement with a local rugby union club.

Magistrate Juliana Crofts acknowledged Macqueen’s good character and early plea as she sentenced him.

Macqueen was convicted, fined $800 and disqualified from driving for six months.

“I hope you’ve had time to think and reflect (on your actions) … because had there been an accident I’m sure there would have been a lot of people who would miss you,” Ms Crofts said.

“It only takes a moment … for terrible things to happen.”
