Trevor Ray Hicks: Southgate man convicted of breaching apprehended domestic violence orders (ADVO)

A northern NSW father who abused his ex over text, breaching a DV order, told her “ya old boy should of blew your head off” and threatened to bash the woman.

A Telstra contractor found himself before a court after he sent a sickening text to his ex amid a spate of harassing calls and texts, writing “ya old boy should of blew your head off”.

It marked Southgate man Trevor Hicks’ second breach of an apprehended domestic violence order (ADVO).

The 30-year-old man fronted Grafton Local Court to be sentenced after pleading guilty to the two breaches.

The orders were taken out against Hicks by his stepfather and the other by his former partner.

As part of the order, Hicks was directed not to approach his stepfather.

But the man noticed Hicks drive past his home about 7pm on March 19 last year, coming within about five to 10 metres, the court heard.

When police interviewed Hicks, he said flooding prevented him from using Lawrence Rd, his usual route, and forced him to drive past his stepfather’s property to get to work.

“Police informed (Hicks) that at the time of the alleged offence the flood had receded and Lawrence Rd was open,” court documents state.

The second breach of the orders occurred when Hicks contacted his former partner with “numerous text messages and missed calls”.

In one explicit message, Hicks wrote: “Listen you spastic c--t never again!”

“I told you not to have any c--t round … I’ll bash ya heads together u f--king gronks ya old boy should of blew your head off! (sic)

“Make me sick ya not a mother’s a--hole u shouldn’t be round kids u sick f--k!”

The woman reported the abusive messages to police on July 19, 2022.

Hicks, who was self-represented, told the court he was trying to tell his ex to “pull her head in” and did not mean to be threatening.

The court was told he was a self-contractor for Telstra.

He claimed his partner was lying when she said he had threatened to shoot her.

But Magistrate Juliana Crofts told Hicks “we’re talking about your behaviour, not theirs”.

“Domestic violence offences are very serious matters,” she said.

However, Ms Crofts also told the court Hicks had demonstrated understanding of the harm domestic violence caused and he presented a low risk of reoffending.

“It sounds like you were in a difficult situation ... ,” she advised, telling Hicks to be better behaved.

Ms Crofts convicted Hicks and sentenced him to an 18-month community corrections order, with 100 hours of community service work.
