A magistrate will assess the seriousness of videos that have been added as evidence against a Grafton man who has pleaded guilty to possessing child abuse material.

Dale Jerel Rixon’s two charges of possessing child abuse material and another of possessing a prohibited drug were mentioned in Grafton Local Court on Wednesday.

The police prosecution made submissions of further images, videos and a substitute categorisation schedule of seriousness.

Mr Rixon’s lawyer, Anne-Alece Johnston, also tendered new evidence – a document related to Mr Rixon’s counselling.

Magistrate Kathy Crittenden said the court could not speculate on the contents of the video as it had been submitted as new evidence.

“In fairness to all parties it is imperative the court has access to the videos to assess the seriousness,” she said.

“I can’t express the seriousness enough,” she said.

When considering the seriousness of the matter she listed considerations for child pornography matters included the number of images, the nature of acts, the ages of the children, the degree of planning and storing and whether or not the defendant acted alone.

Mr Rixon has pleaded guilty to two charges of possess child abuse images and possess a prohibited drug.

That matter will be for mention again on March 21 to fix a date for the final outcome.
