A man charged with assault following an alcohol-fuelled brawl in the CBD has told a Sydney court he made “a dumb mistake”.

But despite already being before the courts for a second matter allegedly involving violence, and police opposing bail, Joshua William Mosley was allowed to walk free from custody.

Further, Magistrate Spence even wished the 22-year-old a “happy birthday” and made reference to the 1980s hit film Back to the Future.

Police allege the Russell Lea man was involved in a brawl at the Watershed Hotel in Darling Harbour about 1.35am on Saturday.

Police allege a 39-year-old security guard and a 22-year-old patron were assaulted.

The younger man was taken to Royal Prince Alfred Hospital with facial and head injuries; the security guard was uninjured.

Mosley appeared before Parramatta Bail Court on Saturday charged with common assault, affray, and possessing a prohibited drug.

“The police gave him a good report, the accused appears to be remorseful and officers say it was out of character,” Magistrate Spence told the court.

Police prosecutor Alexandra Eisen said the police “did give him a good wrap”, but maintained officers opposed bail on grounds he “it was alcohol-fuelled violence and he is on bail for violent offences”.

Asked by Magistrate Spence if he enjoyed staying in prison overnight, Mosley responded “not really, I have learned my lesson”.

“It has been a tough year for me and there has been stuff emotionally going on in my head,” Mosley said.

Mosley was granted bail with a $500 forfeiture amount and told to not take drugs or drink alcohol.

He will appear at Downing Centre Local Court on December 22, one day before his 23rd birthday.

In a separate matter which occurred two hours earlier on the same street, Christopher Lloyd also appeared before Magistrate Spence.

Police allege the 29-year-old produced a knife during a fight near King and Kent streets about 11pm on Friday night.

During a police search police found $10,000 in his underwear. He was charged with affray, wielding a knife in a public place, goods in personal custody suspected of being stolen, possessing a fake licence, and breach of bail.

“Isn’t there a famous actor called Christopher Lloyd?” Magistrate Spence asked the offender.

“Back to the Future your honour,” Lloyd said, referencing the 1980s film.

Another man, a 31-year-old, was charged with affray and intimidate and was granted bail.
