Temple Deane-Johns in Coffs court accused of sex act in car at Boambee

The man, who’s lived in Coffs all his life, has an extensive criminal history which is ‘increasing in seriousness and frequency’ the court heard.

A man stands accused of forcing a woman to perform oral sex on him in a car in the Coffs Harbour area earlier this month.

Temple Deane-Johns appeared before Coffs Harbour Local Court via audio visual link on Monday, August 15.

He has been remanded in custody since his arrest, following the alleged incident on August 9.

The alleged victim came forward on the afternoon of the following day, the court heard.

The 43-year-old is charged with having sexual intercourse without consent and possessing a prohibited drug (cannabis) on August 12 when he was arrested and remanded in custody.

Police allege he forced the woman who is known to him, to perform the sex act on him while they were in a car at North Boambee.

His lawyer, Scott James, conceded it was a serious allegation but argued his client should be given bail as he will end up spending a “significant amount of time in custody” before the matter is dealt with.

Mr James told the court his client is “strongly adamant that the encounter was completely consensual” and “where the truth lies is a matter for a jury or another judicial officer”.

Deane-Johns has lived in the Coffs Harbour district - predominantly in the Nambucca Heads area - most of his life, the court heard.

He lives on a disability support pension due to a mental health issue, Mr James told the court.

Police prosecutor Jack Chaffey argued he should not be given bail and that he has an extensive criminal history involving firearms, drugs and “some violence offences” and the matters are “increasing in seriousness and frequency”.

Magistrate Ian Rodgers outlined the details of the case saying it will potentially “come down to the complainant’s credibility”.

Mr Rodgers refused bail and the matter was adjourned to October 11.
