The brother of the man who died in the Clarence Correctional Centre last month has failed to appear in court.
Taban Dongrin was due to appear in Coffs Harbour Local Court on Tuesday, July 5.
The 32-year-old is currently on bail, charged with assault occasioning actual bodily harm, two charges of common assault and two charges of stalk/intimidation.
He is the older brother of Dictor Dongrin who was found unresponsive in the medical holding room of the privately-run facility on June 13 before he was later pronounced dead by NSW Police.
The brothers had both been remanded in custody in relation to the alleged assault of their parents at their Coffs Harbour home on Saturday afternoon, June 11.
The brothers had been drinking in the lead up to the alleged assault with Magistrate Ian Rodgers describing Taban as having an “out of control problem in relation to alcohol use” when he appeared via audiovisual link on Monday, June 14.
Taban Dongrin’s lawyer Scott James argued he should be granted bail in order to attend his brother’s funeral and that he was the “lesser player” in the alleged incident that left their father dripping blood onto the veranda from a cut to the head.
Mr Dongrin was granted bail to live at a Korora address and not at the family home and to report to the Coffs Harbour police station every Monday.
He was also directed to abstain from alcohol and not enter any licensed premises.
After he failed to appear in Coffs Harbour court on July 5, Magistrate Michael Dakin adjourned the matter saying Mr Dongrin must appear on July 19 and enter a plea, otherwise a warrant will be issued for his arrest.
