Elderly man in Coffs court charged with sending sex photo and video

A 62-year-old man already on bail for allegedly recording an intimate image without consent has found himself back before the magistrate.
This time he is alleged to have sent a video of himself having sex with the same woman to another person without consent on November 14.
The video was allegedly sent to a mutual friend.
The alleged offender, who cannot be identified for legal reasons, had previously pleaded not guilty to the charge of intentionally record intimate image without consent etc (domestic violence).
Acting on the 62-year-old’s behalf in Coffs Harbour Local Court on Tuesday, November 15, lawyer John Hennessey argued his client should be released on bail, telling the court he would be very vulnerable in jail.
“As you can see your honour, he is a slightly built man of old age,” Mr Hennessey said.
The alleged offender works full-time and cares for his father, Mr Hennessey told the court.
Magistrate Ian Rodgers told Mr Hennessey “I’ve got real problems granting him bail” and that it was an “outrageously strong case” against the 62-year-old.
Mr Rodgers determined the man had breached his bail and formally revoked it - he will be remanded in custody until the case next comes to court on December 6 when a plea will be entered for the fresh charge.
