Luke Hogan fined in Coffs Harbour court for threats, damage

A gyprocker angry after a new set of car tyres were slashed told another man he would “rape your misses”, Coffs Harbour Local Court heard.

Luke Anthony Hogan, 25, was represented but did not appear in court when sentenced on Tuesday for two offences which allegedly occurred at a Urunga address around 11pm on January 8, 2021.

According to the police facts, Hogan had gone to the home and banged on the door, challenging the occupant — who had been known to one another for some 10 years — to step outside and fight.

The victim did not open the door, but told Hogan to leave, police alleged.

Hogan made various threats, including “I’m going to kill you”, “I’m going to kill and rape your misses”, and “I’m going to kill your kids”, according to the police facts.

While guilty pleas were entered to the charges of damage property and making threats, Hogan’s defence counsel told the court there was disagreement as to what was precisely said on the night in question.

The police facts stated that Hogan left the property after making the threats, and the victim then discovered that a glass window next to the front door had been smashed.

Hogan’s lawyer said his client had earlier attended a party adjacent to the victim’s home, where three of four new tyres on his car had been slashed.

The tyres had been a gift by Hogan’s parents, and a blade was left in one of them, his lawyer said.

Hogan had been a resident of Urunga at the time but had since relocated to the Central Coast, the court heard.

Magistrate Michael Dakin fined Hogan $400 for intentionally or recklessly destroy/damage property, and $750 for stalk or intimidate intending to cause fear of physical or mental harm.
