Luke Daniel Proctor pleads guilty at Coffs Harbour court to high range drink driving

It was a Coffs Coast’s man first drink driving offence - but the reading was eye-watering after police stopped a 4WD on the major regional link road of Waterfall Way.

According to police facts, it was “immediately obvious” the driver was heavily intoxicated as they neared his vehicle on Waterfall Way.

A Coffs Coast man wasn’t far from home when a police patrol spotted a Ford Territory wandering across the road near Fernmount.

“The accused was constantly swerving from left to right and back again as he travelled along the roadway, crossing onto the incorrect side of the road numerous times,” court documents state.

The erratic movements of the 4WD at 8.35pm on May 20 caught police attention as they patrolled Waterfall Way.

They stopped the vehicle and as they approached the driver’s side “it was immediately obvious that the accused was heavily intoxicated”.

Luke Daniel Proctor, 41, of Fernmount submitted to a roadside breath test which proved positive, while an analysis at Bellingen Police Station indicated a reading of 0.348 - almost seven times the legal limit.

Proctor’s licence was immediately suspended and he has pleaded guilty to one count of drive with high range prescribed concentration of alcohol - first offence.

At Coffs Harbour Local Court on Wednesday, Magistrate Julia Virgo adjourned the matter to July 26 for sentence.
