“That’s crazy”, a Mid-North Coast magistrate said before overturning a teen’s licence suspension for driving the same high performance vehicle he drove while on his learners.
Al Frances Rosales - sporting an impressive afro – appeared before magistrate Julia Virgo in Coffs Harbour Local Court on Tuesday to appeal the suspension of his licence.
The 18-year-old lost seven points, leading to the total suspension of his licence, after he was detected driving what the law classifies as a high performance vehicle.
He lodged an appeal on December 18 last year and this was upheld in court on Tuesday.
His lawyer told the court the high powered vehicle in question was the same car Rosales had used to do his learner hours - a 25-year-old car belonging to his father - which would have lost a lot of its original power over the years, he added.
“That’s crazy,” Ms Virgo said, adding that the law surrounding high powered vehicles was “opaque” and that she had empathy with Rosales’ case.
“Many people are caught unaware,” Ms Virgo added.
Transport for NSW lawyer Tony Cox told the court the relevant laws were accessible via a simple “online search”.
According to court documents, Rosales is a hygiene cleaner in hospitals and requires his license to travel to various locations including Tamworth and Ballina.
He is also employed as a photographer with bookings up until July this year and travels between the Gold Coast and Sydney for shoots.
