A woman climbed up an excavator in a Lennox Head construction site to escape her drunk and abusive partner on a family holiday, a court heard.
Queensland man Deng Bol Biar, 39, pleaded guilty at Ballina Local Court to common assault and breaching an AVO.
The Rockville couple began arguing about Biar’s drinking on Ballina St in Lennox Head about 1pm on September 30 last year.
Biar slapped his partner across the face and when she tried to remove herself from the situation he followed her, according to court documents.
The woman ran towards a nearby excavator and scaled it while screaming out for help.
Biar pulled her down and pushed her against the machine, “slapping and punching the victim multiple times”, police documents state.
The woman began running around the excavator with Biar in pursuit.
She threw her phone to a bystander and told them to call triple-0.
“With the assistance of the public, he (Biar) was separated from the victim,” police state.
Officers found Biar in his car with a bottle of whisky and he denied the attack.
Defence Lawyer Tom Ivey told the court on Friday that Biar migrated from Sudan to Queensland in 2015.
He had a rough upbringing in the aftermath of a civil war, the court heard.
“He is aware his alcohol use is problematic,” Mr Ivey said.
“At the time of the offence, he was on a family holiday and snuck off to consume alcohol and his partner followed him outside to confront him.”
“His partner doesn’t allow him to drink at home – he said he is a bad drunk.”
Biar and his partner had been in a relationship for 15 years and an AVO was in place to ensure he did not drink alcohol while with his partner, court documents state.
Magistrate Karen Stafford said Biar had a criminal record in Queensland and all of his offending could be linked to alcohol use.
She sentenced Biar to a two-year community corrections order, which will include alcohol rehabilitation and psychological treatment.
