Ocean Shores man Kayne John Burke faces Byron court after sending threatening messages to woman

A Byron Shire man burst into an “alarming” tirade when the married woman he had been involved with for 17 years broke it off. Here’s how a court dealt with his actions.

The end of an extramarital affair stretching 17 years led to an Ocean Shores man sending “abusive” and “disturbing” voice and text messages to his former partner.

Kayne John Burke, 37, pleaded guilty at Byron Bay Local Court on Monday to intimation intending to cause fear of physical or mental harm and using a carriage service to menace, harass and offend.

The woman was in an “on and off again extramarital affair for 17 years” with Burke before she ended the relationship at the start of November last year, police documents state.

She then received the violent messages, despite asking Burke to stop contacting her four days beforehand

Burke sent the woman 24 voice messages and 13 text messages on December 12, the documents state.

Burke said in the expletive-laden messages: “Hey sl-t, I‘m going to destroy everything you own.”

”I’ll be there in the morning for the f--k you said I was getting or I’ll destroy your life c--t,” he said.

“I’m going to break every window in your f--king house c--t … I’m going to kick your f--king door in.”

“You f--king piece of sh-t.”

The woman feared for her safety, reported the abuse to police and Burke was arrested.

“I did that so I’ll just admit it,” Burke told police when questioned.

Defence Lawyer Anderson Clarke said Burke knew he was in the wrong for sending the “inappropriate” messages.

Burke sent the messages because “the relationship ended abruptly”, the court was told.

Magistrate Karen Stafford described the messages as “threatening” and “serious intimidation”.

“This is criminal behaviour of a very disturbing and alarming nature,” she said.

Ms Stafford sentenced Burke to serve a community corrections order with supervision and an AVO was handed down for two years.
