A drunk Ballina man had downed about 15 or 16 beers when he kicked a police officer in the face after being ejected from a bar.
Fox Oska Talen, 20, told police he had probably taken an ecstasy pill as well before a night out with mates at the Railway Friendly Bar in Byron Bay on September 10.
But things got out of control when he became verbally abusive towards security and hotel staff.
Talen pleaded guilty in Byron Bay Local Court to returning to a licensed premises despite being kicked out several times and assaulting a police officer on duty.
Police documents say Talen “became more agitated” when officers tried to search him for weapons.
“The accused was seriously intoxicated,” police state.
While two officers were trying to secure Talen in the back of a paddy wagon, he kicked one of the police officers in the face.
Police state when Talen was in custody at Byron Bay police station, he began frothing at the mouth and was taken to hospital in a semi-conscious state.
Talen’s mother told police her son was on prescription drugs for a medical condition that could not be mixed with alcohol.
Documents state Talen returned to the police station the next day “apologetic” and showing “genuine remorse” and told police he wasn’t sure if he had or had not taken an ecstasy pill.
The Byron court heard Talen had lost his dad to lung cancer in 2019 and this experience had been a “wake-up call” for him.
His lawyer said his client had not consumed alcohol since the night of the offence.
Magistrate Karen Stafford said Talen’s behaviour was “stupid” and he was hanging around with the wrong crowd.
She said he needed to spend more time with the Men’s Group because they could be role models for him.
“You kicked an officer in the face. Imagine if you were a shelf stacker and someone came up to you and kicked you in the face (while you were working),” Ms Stafford said.
She convicted Talen and fined him $1800 and directed him to complete a 12-month community corrections order.
