Byron Bay: Adam James Pomeroy pleads guilty to drink driving and driving without a licence

A father of five was busted behind the wheel drinking from a can of Jim Beam Bourbon and cola without a licence. Here’s what we know.

A father of five was busted behind the wheel drinking from a can of bourbon and cola without a licence.

Adam James Pomeroy, 44, of Pimpama QLD pleaded guilty at Byron Local Court on Monday to driving while intoxicated and driving while disqualified.

Agreed police facts state officers were patrolling Jonson St, Byron on March 22 about 12pm when a blue Hyundai hatchback accelerated in front of police.

Pomeroy was pulled over on Shirley St and told police: “I was doing the speed limit”, facts continue.

When officers asked him if he had consumed any alcohol he lifted up a half empty can of Jim Beam Bourbon and cola and said: “I’m drinking one now”.

Officers asked if Pomeroy had a driver’s licence and he said “no I don’t, no licence at all.”.

He later explained to police he tried to get one when he was a teenager but failed the test.

“Pomeroy told police he drove into town to buy more alcohol as if was his partner’s 40th birthday,” court documents state.

As police spoke to him, they noted his speech was slurred and slow, he smelled like alcohol and his eyes were glazed.

Officers did a roadside breath test which recorded a positive result and Pomeroy was arrested and walked to Byron Bay Police Station.

Pomeroy told officers he had consumed five cans of alcohol and a secondary breath test returned a blood alcohol reading of 0.148, almost three times the legal limit.

Police facts state Pomeroy was quiet and respectful while in custody and showed remorse for his actions.

Officers labelled him as a “habitual offender” in police facts and stated his NSW traffic history was “appalling”.

The case has been adjourned to July 7.
