Alexander Luckman refuses to enter NSW for court due to arrest warrants

A Queensland man charged over an incident in Byron Bay has told a court officer he won’t be coming into NSW after learning he had “multiple” outstanding warrants.

A warrant has been issued for the arrest of a Queensland man who failed to front court for a hearing into domestic violence allegations in Byron Bay.

Alexander Jack Leonard Luckman, 36, was due to face Byron Bay Local Court on Wednesday on charges of assault occasioning actual bodily harm and contravening an apprehended violence order.

Luckman, who according to court documents has lived in Surfers Paradise and also possibly Miami on the Gold Coast, failed to appear in court.

He has told court staff he had no intention of entering NSW because there were warrants out for his arrest.

The court heard Luckman phoned the court registry on October 14 to say he would be interstate and was unvaccinated so he couldn’t attend court because of the Queensland border restrictions.

The staff member he spoke to informed Luckman court proceedings were not impacted by the border closures and he was still expected to face court.

Luckman was told he could apply for the hearing to be vacated but he made no effort to do this, the court heard.

He then asked the court staffer if he had any outstanding warrants in NSW and when they confirmed there were multiple, he told them he wouldn’t be coming to court.

Magistrate Karen Stafford on Wednesday noted Luckman had not shown up and convicted him of both charges and ordered a warrant to be issued for his arrest.

Luckman had entered not guilty pleas for both charges on April 19.

Police allege Luckman breached an existing apprehended violence order and assaulted a woman, inflicting actual bodily harm to her, between 3pm and 3.30pm on August 2 last year.

Luckman was prohibited from having contact with or being within 100m of his alleged victim but according to court documents, the pair drove to Byron Bay together on August 1 last year and stayed overnight.

Luckman drove the victim’s black Mercedes sedan to Byron Street about 3pm the next day.

The victim was in the passenger seat with her two small dogs when police allege Luckman struck the woman to the left cheek and then continued to assault her by placing her in a headlock.

She lost an earring and police later saw her earlobe had been bleeding.

The woman escaped the car with her dogs and walked along Jonson Street and down a laneway.

Luckman had driven off but returned in the vehicle a short time later.

The woman got her car keys from Luckman, entered her vehicle and phoned Triple 0.

Meanwhile, Luckman was pacing in front of the vehicle, court documents said.

The woman was “visibly upset, crying and distressed” with visible injuries when police arrived a short time later.

While the woman didn’t want to take part in a recorded interview, she allowed police to photograph her injuries.

Luckman tried to phone the woman while she was in the presence of police and later sent her text messages, including a photograph of her speaking with police.

All of those actions, police allege, contravened the apprehended violence order.
