Eloise Claire Spencer on drink driving charge at Byron Bay

There was no food in the Airbnb where she was staying, but a decision to drive to a servo ended in court. See why.

A woman who was busted drink-driving after police witnessed her cross onto the wrong side of the road has blamed late night food cravings for the incident.

Former school prefect Eloise Claire Spencer, 23, pleaded guilty to a drink driving charge when she appeared at Byron Bay Local Court on August 15.

Spencer, from Queensland, drove a bronze BMW on the wrong side of Johnson St just after 11pm on July 17, when it was alleged in court documents she was witnessed by two police officers.

The officers pulled her over due to the nature of her driving and performed a breath test, where Spencer blew a mid-range reading of 0.110.

Magistrate Michael Dakin convicted Spencer, imposed a six-month licence disqualification and fined her $600.

Spencer’s lawyer, Van Derhoven, told the court she was driving to the nearest service station as there wasn’t any food at the Airbnb where she and her partner were staying, and she couldn’t order delivery.

Mr Dakin said this was no excuse and still counts as “serious offending”.

“She decided to drink and drive,” he told the court.

The court heard she had consumed an unknown amount of wine and cocktails that Sunday night.

Mr Dakin said Spencer could apply for a driver’s licence when eligible in six months.

If granted, she will have an interlock device installed in her car for 12 months.

“If that (licence application) is not accepted you will have to wait five years until you can apply again for it,” Mr Dakin said.
