The Land and Environment Court dispute between the operators of a Brunswick Heads holiday park and Byron Shire Council is nearing completion

The case has focused on a dispute about whether there would be adverse impacts on an endangered ecological community on the site.

A Land and Environment Court case between Byron Shire Council and a Brunswick Heads holiday park was nearing completion.

At the heart of the conflict between the parties has been the presence of a coastal cypress pine population in the southern precinct of the park and whether or not that endangered ecological community would be at risk from ongoing operations in the southern precinct.

NSW Crown Holiday Parks Land Manager, trading as Reflections Holiday Parks Terrace Reserve, brought a deemed refusal appeal before the court after it sought permission for the ongoing operation of the campground and caravan park.

The case relates to the most eastern of Reflections’ three Brunswick Heads parks.

The council’s legal counsel Ralph James said while a judgment has been delivered in the court case, the matter was not exactly complete.

“Her Honour has delivered a judgment in the matter and it said she was going to grant approval to operate but she wanted certain things done with the Vegetation Management Plan and the granting of approvals to operate,” Mr James said.

“Council’s experts have made comments in relation to the draft Vegetation Management Plan and we provided those to the court on the 5th of July.”

He said the applicant was then given a chance to review and respond to the council’s comments.

That’s due to be completed by this Friday.

“We have done our work on the VMP. The applicants are doing their bit,” Mr James said.

“In terms of the conditions of approval we’ve put up our draft conditions. The applicant has considered those and made comments on a few of them.”

Mr James said the court would then make a formal determination.

“I don’t think they’re going to determine the application this week,” he said.
