Malachi Freeburn sentenced in Ballina Local Court after breaking man’s nose in Evans Head

A teen has been dealt with by a court after police discovered an injured man sprawled against a fence at Evans Head in northern NSW on New Year’s Day.

A teen has been sentenced after police found a man sprawled against a fence with a broken nose in a Northern NSW tourist town on New Year’s Day.

Malachi Freeburn, 19, pleaded guilty to assault occasioning bodily harm, assaulting a police officer and resisting a police officer when he faced Ballina Local Court on February 2.

The victim was found sprawled against a fence in Evans Head with a broken nose and blood spread across his face, police documents state.

The court heard the victim called Freeburn a “mother-f--ker” before the attack.

Freeburn and the man were walking together at the time.

The victim was punched and fell to the ground when Freeburn punched him, according to court documents.

“His nose was bleeding heavily with red marks around it,” police state.

The victim refused to be taken to hospital for his injury.

Earlier in the night, Freeburn ran away from police after being caught with bottles of alcohol in his pockets in an alcohol-free zone.

Freeburn fell over and shoved a police officer before he was capsicum sprayed and arrested.

Freeburn apologised to the officer, was released from Evans Head Police Station and then broke the man’s nose.

On March 24, Magistrate Karen Stafford sentenced Freeburn to a two-year community corrections order with no conviction recorded.
