A Newcomb man threatened his friend’s car with a hammer over a missing bottle of bourbon he said he was owed, a court was told.

A Newcomb man who said he was promised bourbon for painting a friend’s house became abusive and smashed the window of their car when they failed to pay him, a court was told.

Kristian Loricco, 46, returned to the friend’s Newcomb home five times in one day before taking a hammer to the passenger side window of a car and threatening to damage the rest if he was not paid the bottle of bourbon for his paint job.

He pleaded guilty to the criminal damage and to a charge of theft from Dan Murphy’s in the Geelong Magistrates Court on Tuesday.

A month later, in December 2021, Loricco was in a Newcomb medical practice when a doctor asked him to leave because he was being inappropriate in the waiting room, including playing loud music.

Loricco left but later confronted the doctor as he was returning from his lunch break and became verbally aggressive.

In fear, the doctor rushed into the practice and locked the doors.

Loricco became angrier and tried to force open the doors, causing the glass to smash.

He also faced court for riding an unlawful e-scooter while under the influence of alcohol and methamphetamine.

In June this year, Loricco attempted to pay for bourbon cans at Dan Murphy’s but walked out with them when his card was declined.

Defence lawyer Megan Campbell said at the core of the offending was Loricco’s “series of head injuries over the years” which left him with a “possible acquired brain injury” and an intellectual disability.

“While this is serious offending, he has shown the ability to rehabilitate somewhat and I think he might benefit from supports through a (community) corrections order,” Ms Campbell said.

Magistrate Franz Holzer agreed the “ability to regulate his behaviours is at the core of his difficulties” but asked Loricco to have a “need for respectful interactions” when he becomes upset.

“Damaging property or doing the wrong thing, in whatever form that may take, is something you need to avoid,” Mr Holzer said.

Loricco was convicted and handed 50 hours of community work.
