Melton man Tyson Barry assaulted man outside Geelong CBD’s The Deck bar

A Melton man fractured a stranger’s face outside a Geelong CBD bar, sparking a drunken brawl.

A Melton man, who stumbled out of a bar in the Geelong CBD, punched another man in the face and left him with serious fractures.

The victim had stepped between Tyson Barry, 27, and a female friend outside The Deck on Gheringhap St when he was hit with a closed fist.

As soon as the victim hit the ground, an “all-in brawl” erupted between the victim’s friends, Barry and one of Barry’s friends.

Barry pleaded guilty to recklessly causing injury and affray in the Geelong Magistrates Court on Monday morning.

The court heard Barry left the bar at about 8pm on a night in December 2021 but was quickly confronted by a security guard who noticed he had taken a glass of alcohol from the venue.

Barry became angry and threw the glass onto the ground.

The victim and 15 of his friends were outside and watched this unfold.

The following assault left the victim with a fracture to the bone above his two front teeth, which eventually caused both teeth to die.

Security were forced to intervene to stop the brawl.

Defence lawyer Bethany East said Barry had “moderately decreased his use of alcohol” since last December.

“It is certainly not an excuse, but there was a role of alcohol in the offending,” Ms East said.

The prosecutor, Craig Williams, said it was “serious offending” and a term of imprisonment “would not be out of the range”.

“It’s in the context of alcohol consumption and the community expects these matters are dealt with accordingly because they do significant harm to the community,” Mr Williams said.

Magistrate Jonathan Klestadt agreed, telling Barry the matters were “very serious for obvious reasons”.

“That sort of behaviour in a public place with alcohol as the inhibitor regrettably comes to this court very, very often.

“The events that occur can lead to people being extremely, badly injured … and it appears in this case, a person has been extremely, badly injured,” Mr Klestadt said.

The matter has been adjourned for a community corrections order assessment.
