A well-respected real estate agent who fell on top of his partner and injured her during a drunken mishap has been castigated by a magistrate.
Glenn Mitcham, 47, pleaded guilty to a domestic violence assault after he got into a scuffle with his wife before they fell off their veranda on February 25 this year.
Mitcham is employed by Valla Real Estate and has lived in the Nambucca Valley his entire life.
Mitcham's wife spent the afternoon in question in Coffs Harbour supporting a friend, the court heard.
During the afternoon, she attempted to call Mitcham to update him but did not receive a response, while the experienced realtor was drinking at home.
When she returned home around 9.30pm, Mitcham was intoxicated and unhappy his partner had gone out and not called him, the court heard.
Court documents reveal there was a verbal argument before Mitcham’s partner left the home in an attempt to defuse the situation.
Another argument ensued when Mitcham’s partner returned but he prevented her from re-entering the home, prompting the victim to threaten to call the police.
“The accused attempted to grab the victim’s mobile phone from her hand, and this has caused the pair to fall from the veranda and land on the front lawn,” police stated in court documents.
“The impact of the fall caused a laceration on the victim’s forehead, swelling to her left cheek, and the lens from her glasses to come out.”
While on the ground, the pair continued to struggle over the phone which the accused eventually took from the victim.
At Macksville Local Court, Magistrate Scott Nash said Mitcham’s actions were clearly caused by alcohol.
“The simple fact is, if you can’t handle it you should not be drinking,” Mr Nash said.
“Having alcohol might explain what happened but it doesn’t excuse it,” he said.
He sentenced Mitcham to a conditional release order without conviction to be of good behaviour for 12 months.
“This is a case where you had that interaction, you didn’t intentionally cause that action, it was reckless,”
“It’s still serious, it’s domestic violence, it happens often and the court has to send a message that there are consequences. It’s deplorable”.
