The man accused of killing Toyah Cordingley on a Queensland beach has complained the food served to him in an Indian jail is too spicy while he awaits a decision on his extradition to Australia.

The man accused of killing Toyah Cordingley on a Queensland beach has complained the food served inside his Indian jail cell is too spicy, while an application to extradite him back to Australia was heard.

The Delhi court on Friday reserved their order on the request to extradite Rajwinder Singh to Australia for January 24, with the judge saying they will pass the order on that date.

Singh is accused of murdering Ms Cordingley, 24, while she walked her dog on Wangetti Beach, north of Cairns in October 2018 before fleeing to India.

He was on the run for about four years, before he was captured following a million dollar reward appeal by Queensland Police.

On Friday Singh was produced before the Additional Chief Metropolitan Magistrate (ACMM) Ms Swati Sharma to hear his applications.

Rajwinder Singh through his legal aid Advocate Love Deep Gaur also moved an application seeking to move Rajwinder Singh to Single barracks in Delhi’s Tihar Prison.

“Rajwinder Singh is currently lodged in General Barracks where there are 90 other inmates. He is facing issues in food. The food is spicy for him. He should be shifted to a single cell,” his legal aid submitted.

The court has sought response from the jail authorities on the spicy food and moving him to a single cell and will decide on the application on Saturday.

“I will pass an order on January 24” the judge said.

“The file has all documents confirming the extradition request from Australia, his identity documents which confirm this person is Rajwinder Singh” Advocate Digpaul said

“Rajwinder has also given the consent statement seeking to return to Australia”

During the last hearing on January 10, Rajwinder Singh signed the consent statement which reads “I know the consequences and nature of the case and am willing to go to Australia and face the trial”.

Singh was arrested in India on November 25 last year during a joint operation by Delhi Police’s Special Cell, Central Bureau of Investigations, and Interpol, while on his way to a doctor’s appointment in New Delhi.

Singh isn’t represented by a private lawyer, instead, the court provided him with legal aid to go through the documents and processes. He didn’t hire one to contest charges but instead sought to return to Australia and ‘contest the charges there.’

“I will tell the court over there (in Australia) what happened … I am not a killer but an eye witness to the murder,” Singh told The Courier-Mail on January 7, 2023.
