'No body, no parole laws’ helps police find missing remains

A double murderer who killed his wife and stepdaughter in rural Queensland yelled “I didn’t kill her” in a spectacular spray during a court hearing which would determine his potential release.

Rodney Michael Cherry faced his second parole hearing for the year on Friday, more than 20 years since killing his family members.

Cherry, who sported a large grey beard and was dressed in prison clothes, yelled throughout his video link from jail, claiming he never killed his stepdaughter and could find her if he was released from prison.

“I didn’t kill her,” Cherry yelled repeatedly. “I may be able to find her but I won’t be able to find her with my hands behind my back.”

In 1997, Cherry handed a loaded gun to his stepdaughter Deborah Guise, 19, and told her to kill her mother, Annette Cherry.

Cherry had been sexually abusing Deborah’s sister Kira Guise, and was angry at his wife because she had given police affidavits about her knowledge of the abuse.

Cherry then murdered Kira, 17, in 1999 because she knew of his part in her mother’s death.

Her remains have never been found.

Cherry received two life sentences for the murders of Annette and Kira, with a mandatory minimum custodial period of 20 years.

Deborah Guise was convicted of her mother’s manslaughter and later perjury after giving false testimony during two Supreme Court trials.

Cherry has repeatedly denied killing Kira, and claims she disappeared without a trace.

He appealed his convictions in 2004 but it was dismissed.

Under Queensland law, Cherry is considered a no body, no parole prisoner.

At a parole hearing on Friday, the board met to consider whether Cherry had given satisfactory co-operation in the investigation to find Kira’s body.

But Cherry didn’t offer any new information which could help find her, instead repeatedly claiming he was innocent, airing his frustration about the police, and asking irrelevant questions to Detective Chris Knight about the investigation.

Cherry was warned multiple times by the board about the irrelevance of his line of questioning, which made him visibly angry.

“You are not listening to what I’m trying to say. I did not kill Kira Guise.

“The longer I remain in prison with the focus wrongly placed on me, should Kira be murdered, then further away her killer gets while I am being denied the opportunity to do what I could have done many years ago.

“If you want to deny me my parole, then there’s nothing I can do about it. But that also means there’s nothing further I can do (to find Kira).”

The board will consider all evidence and deliver a decision on Cherry’s parole next year.
