A Brisbane-based OnlyFans adult content creator has been accused of filming himself raping his unconscious girlfriend and uploading it to the subscriber platform.

Police allege the woman only found out about the rape when her new boyfriend alerted her to the video online in which her ex is allegedly heard telling her: “this is what happens when you take drugs you don’t know about, this is to teach you a lesson”.

According to court documents, when the woman later confronted him about the video, he told her: “You spat on me once during sex. You like that kind of kinky sex”.

The 33-year-old man, who cannot be identified in order to protect the identity of the complainant, was charged with one count of rape and one of recording in breach of privacy arising from the alleged incident in May 2021.

He has already spent more than 600 days on remand since his arrest in January last year and faced the Brisbane Supreme Court last week for a third failed application for bail.

In documents filed as part of the application, it was revealed the accused and the 27-year-old complainant had been in a relationship since 2020 after meeting via an online advertisement for a threesome.

“The complainant worked as an escort, using the defendant’s spare bedroom, and they would share profits,” the document said.

“The complainant also had an OnlyFans account that was run by the defendant.

“They would also share the profits from this account.”

On the day of the alleged offending, the woman had been drinking Baileys and consumed a Xanax tablet and remembered walking upstairs to her bedroom.

“The next thing she was able to recall was waking up feeling hungover with the defendant in bed next to her,” the prosecution affidavit said.

“The defendant showed the complainant videos of herself on his mobile phone.

“In one video the defendant was touching her face, she appeared to be unconscious and did not respond to the defendant’s actions.”

Police allege in one video, the defendant set up his phone at the end of the bed where the complainant was lying “apparently unresponsive” before he had sex with her.

“After approximately 45 seconds the defendant stands and picks up the phone, focusing the camera on … (the woman’s vagina),” the documents allege.

“The complainant appeared unresponsive throughout the entirety of the video.

“In a further video the defendant was heard saying words to the effect of “this is what happens when you take drugs you don’t know about, this is to teach you a lesson”.”

Police allege the complainant did not give the defendant permission to have sex with her, or to film the act.

In an affidavit filed by the man’s lawyer, he said it was alleged the complainant had been shown the video and continued in their relationship and that the defence of consent may be an issue at trial.

“It wasn’t until the complainant’s new partner became aware of images/videos posted on OnlyFans that a complaint was made,” he wrote.

“The applicant often engages in role-play scenarios consistent with the videos published on his OnlyFans page.

“Consent is again an issue in dispute.”

The man’s charges have been committed to the District Court and he is likely to face a trial next year, however no date has been set.
