Maryborough man found guilty of one count of raping partner

A man has been found guilty of one count of rape after a jury was told he sent his victim messages telling her “I don’t deserve to be alive for what I’ve done to you … I deserve to rot in hell”.

The man, who cannot be named for legal reasons, had pleaded not guilty to two counts of rape when he faced trial at Maryborough District Court this month.

The trial, being presided over by Judge Vicki Loury, began with an opening statement from Crown prosecutor Steve Dixon, who told the jury that the man sent messages to the woman after she had detailed some of the health effects she was suffering after he had allegedly raped her.

“I don’t deserve to be alive for what I’ve done to you. I deserve to rot in hell,” was one of the messages he sent, the court heard.

The man, who cannot be named for legal reasons, pleaded not guilty to the two charges when he faced Maryborough District Court on Tuesday.

Mr Dixon said the two had been in a relationship at the time the rape happened.

The man was aged 21, the woman was in her mid-30s.

The jury deliberated for a number of days after the trial concluded and found the man guilty of one of the counts of rape.

However they were unable to reach a verdict on the other charge.

The man will be sentenced in Brisbane District Court on December 14.
