A man’s illicit relationship with an underage girl was discovered when a video he made of the two having sex was found on her phone.

A young man’s illegal relationship with an underage girl was discovered when a video of the two having sex was found on the teenager’s phone.

The court heard the girl was 13 years old when Honess began exchanging messages with her on social media in 2021.

The two had an open relationship, which was on again, off again, the court was told.

He repeatedly asked her to send photos of herself naked, which she complied with, and he also sent a photo of his penis, the court heard.

One night, he arranged to meet with the girl about 10.30pm.

Honess went to her home and picked her up after she snuck out.

They went to a motel and had sex, the girl at first protesting and then acquiescing, the court was told.

Honess filmed while the two had sex.

When he dropped her home later, he told her not to tell anyone and that he would kill himself if the police found out.

The offending was discovered later when someone opened the girl’s phone and saw the video images, the court was told.

Police then executed a warrant at Honess’ home, where he made some admissions regarding his actions, but said he did not have intercourse with her.

Honess had an unsettled childhood, the court heard, and had been exposed to drug use and domestic violence.

His education had been impacted by his below average intelligence, but he had been gainfully employed, including working as a deckhand on a trawler.

 Judge Michael Burnett said he was conscious of the need to support Honess’ rehabilitation.

He was sentenced to two years in prison, to be suspended after six months for an operational period of two years.

Honess was also sentenced to 18 months on probation.
