High-flying Maserati-driving chiro walks free after sex assault patient

A high-flying Maserati-driving chiropractor turned medical mogul has received a suspended sentence after sexually assaulting a female patient.

A high-flying Maserati-driving former chiropractor turned medical mogul and international conference speaker, has walked free from court on a suspended jail sentence after he admitted sexually assaulting a female patient during an after-hours appointment.

Martin Drew Timchur, 45, a married father-of-three from Buderim on the Sunshine Coast, who is a former director of the Queensland branch of the Chiropractic Association of Australia, was in the Magistrates Court in Brisbane on Monday where he pleaded guilty sexually assaulting the woman at a Jindalee medical practice on June 29 last year.

Timchur checked what time the practice receptionist was going home for the day, and how to lock up the business before the assault, the court heard.

“At that stage, there must have, or there should have been a realisation that this is madness,” Magistrate Peter Saggers said in sentencing him to a nine-month prison term, suspended for 18 months.

Legal officer Pip Harvey Ross, for the Crown, submitted that Timchur should serve actual time in prison and the sentence should not be suspended.

Mr Saggers said that Timchur had initially denied the woman’s claim of assault and sought to deflect blame “due to embarrassment” but later conceded he had molested his patient.

Mr Saggers told Timchur that his behaviour was “brought about by yourself” and he was right to feel ashamed.

The assault triggered the collapse of Timchur’s “successful lifestyle”.

Timchur posted on Instagram photos of his Maserati with the registration plate SPINE2.

“You are a man who had never come before the courts, who was highly regarded in his profession, with significant qualifications both in chiropractic and then radiology, you had what would have seemed to have been a successful business,” Mr Saggers said.

On his Instagram profile Timchur described himself as an international speaker, senior lecturer in radiology and CEO of a health IT company.

Timchur is the chief executive and founder of Vivatus Healthcare, and a director of Diagnostic Imaging Solutions and was a senior lecturer in diagnostic imaging at Central Queensland University when he was charged in July last year.

He was now “involved in Bonfire (Wellness) medicinal cannabis and other radiology businesses” and has shown “obvious drive” and ambition in his work achievements, Mr Saggers told the court.

“Your behaviour on this evening has brought it all crashing down, and as you quite rightly concede has irreparably stained you, and brought great shame to you, brought great shame no doubt and embarrassment to your wife and to your children,” Mr Saggers said.

“I don't know what it must be like to explain that to your children, to your 14 year old daughter,” Mr Saggers said.

“To say that, for her to understand that that’s what her father has done in the course of his business is incomprehensible,” he told Timchur.

“But you can imagine too, I expect, how the (victim’s family) would feel, as you too would feel if it was your wife who had gone to the chiropractor on this particular afternoon or your 14 year old daughter who had gone for a massage. You would be outraged,” he said.

In her victim impact statement, the woman told the court she fears being alone with any men, even men with whom she is friendly.

Mr Saggers also ordered that Timchur pay his victim $10,000 in compensation within one month.

Timchur is no longer listed as a registered chiropractor on the Australian Health Practitioners Regulation Agency website.
