A former top Queensland sales manager with the nation’s largest home builder has sued his former employer for $588,000 claiming it ripped him off by underpaying his commissions.

A former top Queensland sales manager with the nation’s largest home builder has sued his former employer for $588,000, claiming they ripped him off by underpaying his commissions.
Jason Klos, from Bundall on the Gold Coast, has sued Metricon Homes Queensland Pty Ltd in Brisbane District Court, alleging that when he started his job in January 2017 as sales manager for MetInvest, the investment-home division of Metricon Homes, he was entitled to commission of up to $3285 for each house he sold, as part of his job contract.
But Mr Klos, who was a manager in both Queensland and northern NSW, states in his claim that on December 4, 2018 Gold Coast-based Metricon Qld wrote to him to say that that from August 2018 his commissions would be slashed to just $1700 for each sale in Queensland and $2190 for NSW sales.
Mr Klos alleges that Metricons bid to slash his commission was “to no effect” because he never agreed to the pay-cut.
He claims he is owed $310,165 owing to him in commissions, as well as further payments including $12,616 in unpaid termination payout when he was sacked in February this year.
He is also claiming an amount of $59,300 for the lost opportunity to sell more homes, and earn commission from these sales.
Mr Klos alleges that he was “stood-down” from his job on November 18 last year in a letter from Metricon general manager Luke Fryer.
Mr Klos claims Metricon stood him down after alleging that he had claimed about $161,800 more than he was entitled to in commissions, an allegation which Mr Klos states was “without proper basis” because his reporting managers approved of the payments.
Mr Klos claims he suffered a $41,990 loss when Metricon did not pay him “full pay” between November 2021 and his sacking in February.
He alleges his sales team sold 45 homes - 34 in Queensland and 11 in NSW - during this time.
Metricon Homes Qld Pty Ltd has filed a conditional notice of its intention to defend the claim.
The notice, filed on June 21, states that service of Mr Klos’ claim failed to comply with the rules.
No hearing date has been set and no defence has been filed.
Metricon has been the country’s largest home builder for the past six years, building more than 6000 new homes nationally in 2020-21.
The company has the naming right to the football stadium in Carrara on the Gold Coast.
