A Queensland doctor has been permitted to practise again after police busted him with a sick stash of child porn involving children as young as three.

A recent Queensland Civil and Administrative Tribunal (QCAT) decision has allowed Dr Adrian Cruz Asinas to practise as a general practitioner in Australia once again after his registration was cancelled over a child porn conviction.

Asinas was sentenced to 15 months in jail, wholly suspended, at Brisbane District Court in February 2020 after pleading guilty to using a carriage service to access child pornography and possessing child pornography.

QCAT court documents reveal how police busted Asinas in September 2018 while he was attempting to delete 20 incriminating videos on his laptop.

The videos included 17 of the most serious category depicting adult men sexually abusing children as young as three.

Police also uncovered evidence Asinas had accessed two files titled “11 yo girl rides the c**k and love it kiddy porn incest s*x naughty little girl s**t, princess, p***y, white a**, gang bang, f****d” and “Pedo Japanese woman sucking a Little boy1,” court documents reveal.

Asinas, who was 41 at the time of his offending, had been registered as a general practitioner and was working in the residential aged care sector at the time.

At sentence, a psychologist’s report detailed how Asinas had “developed into a habit” of viewing adult pornography about once or twice a week after immigrating to Australia in 2010.

According to the report, he became “curious” about under-age girls but denied any sexual interest.

In October 2021, a QCAT decision found that the Filipino-born doctor had demonstrated professional misconduct and cancelled his registration for 18 months from October 31, 2021.

Asinas sought to have his registration reinstated in November 2023, but was refused by the Medical Board of Australia.

However, a recent QCAT decision has set aside the Medical Board’s refusal and has allowed Asinas to practise again under strict conditions.

Presiding over the decision, Judicial Member Julie Dick SC noted that three psychology experts were in agreement that Asinas did not exhibit “signs of sexual deviancy or paraphilic disorder”.

Throughout years of treatment from a forensic psychologist, Asinas had also shown “appropriate remorse, insight and empathy to victims of child exploitation material”, Ms Dick said.

“All the experts agree that the applicant poses a very low risk of reoffending and that while risk can never be entirely eliminated, it can be managed through ongoing support and monitoring.”

Ms Dick ordered that Asinas’s registration be reinstated on strict conditions including that he only practice while supervised and only at approved locations, and that he not practice in relation to patients under 18 years of age.

Asinas does not currently have an approved supervisor or practice location, but court documents note he had an offer of employment at an aged care facility in Victoria.

According to the Australian Health Practitioner Regulation Agency (APHRA), Asinas acquired a Doctor of Medicine in the Philippines in 2002 and joined the Fellowship of the Royal Australian College of General Practitioners in 2018.

His principal place of practice is listed as Tingalpa, Queensland.
