A convicted Gold Coast fraudster who forged documents to get $1.8m in loans has been sentenced for rape after pleading guilty to an assault at in Brisbane in August.

A convicted Gold Coast fraudster who was previously jailed for forging documents to obtain $1.8m in loans has been sentenced to further imprisonment after a court heard he attempted to place a $50 up a woman’s skirt before holding her down and raping her.

Broadbeach man Matthew Michael Nair, 39, who also maintains an address at Kuraby, where the offence occurred, was found guilty of raping a woman aged in her 30s by a jury on August 20 this year.

He was sentenced in the Brisbane District Court on Friday.

The court heard the rape occurred on January 13, 2019.

Nair and his victim were sitting on his couch when he attempted to kiss her, to which she responded, “I don’t want to kiss you,” and asked him to stop, the court heard.

Nair then allegedly attempted to place a $50 note inside her skirt, towards the top of her thighs, prompting the furious response by the woman, “I am not a prostitute”.

The court heard Nair then grabbed her forcefully by the vagina, a sensation the woman described as like “pinching”, before she again asked him to stop.

Nair grabbed the woman by her extended wrists and dragged her into his bedroom, at which point he held her down and raped her, the court heard.

At one point, the woman told Nair, “I don’t want to have sex with you,” to which he allegedly replied, “But I do”.

Nair wasn’t charged with the offence until about 16 months after the assault, the court heard, due to delays in finalising the DNA evidence.

The court heard Nair had shown “no remorse” for his offending and has appealed his conviction, alleging the trial judge had erred in their directions to the jury.

Nair was on bail for the fraud offences at the time he committed the rape.

He was sentenced to seven years’ imprisonment on March 13 last year for the multiple frauds, with parole eligibility set at December 12.

It was submitted on Nair’s behalf he had a number of concerning health conditions, including sleep apnoea and seizures which necessitated his revival in early-2020.

The court also heard Nair, who worked in the construction sector, had a variety of mental health conditions.

He was sentenced to five years’ imprisonment cumulative on his existing sentence, with a parole eligibility date set after he had served half his sentence, due to fall on June 11, 2024.
