Logan man fronts court, captured putting officer in chokehold

A man with previous violent offences has been shown placing a police officer in a chokehold during a domestic callout. Bodycam footage also showed the man’s partner screaming, cursing and crying about the death of a family member before the disturbing altercation.

A Logan man placed a police officer responding to a domestic disturbance in a chokehold before being violently arrested.

Rochedale South resident Shane Peter Orchard, 37, was charged with serious assault of a police officer following the January 22 incident.

A court heard police were called to a Rochedale South address at about 10.15pm with reports of a woman, Orchard’s ex-partner, screaming “hysterically” in a residential courtyard amid a domestic disturbance.

The court was played footage from a bodycam worn by a responding officer (not the one assaulted) which showed the woman screaming, cursing and crying about the death of a family member.

Orchard was seen to be initially helpful and solicitous, telling her to calm down and that police would be unable to take a statement from her about the alleged assault while she was drunk.

However, when Orchard is asked by police to assist his ex-partner into a waiting ambulance, she focuses her rage on him, slapping him crisply over the face multiple times.

When police attempted to separate the pair, Orchard finally snapped, calling the officers “mutts” and “dogs” and placing one of them in a chokehold.

The court heard Orchard grabbed a senior constable around the “jaw and neck and squeezed”, causing the officer to feel instant pain.

Orchard tried to kick and punch multiple officers as he was arrested.

Orchard was on parole at the time of the assault and served about six weeks in custody following his arrest.

The court heard he had previous convictions for violent offences on his criminal record, the most recent a six-month sentence for assault in August 2018.

Defence lawyer John Ide told the court his client showed “admirable patience” in the lead-up to the assault in what was a difficult situation for all involved.

Magistrate Clare Kelly sentenced him to four months’ jail, suspended for 12 months.
