Magistrate busts defendant’s attempt to impress court with fake work reference

Appearing via phone at the Cleveland Magistrates Court this morning Thomas Edward Wolfe, 44, pleaded guilty to driving a motor vehicle while over the middle but under the high alcohol limit.

The court heard Wolfe had caused extensive damage when he crashed his utility into a parked Hyundai at 7.30pm on Oak St in Ormiston on May 1.

Tests would later confirm he had a blood-alcohol level of 0.129 per cent.

Police prosecutor Sergeant Janette Harry said Wolfe, who had a five-page criminal history, had been put on nine months’ probation for other matters on June 18 last year and had been sentenced for drug offences in January.

The court heard the owner of the Hyundai had been sitting in his vehicle when the defendant drove into it.

Wolfe, who was unrepresented and claimed to have worked on boats “since I was able to”, disputed this and said the man had been in a nearby property.

However, the defendant admitted to crashing into the vehicle while drunk.

Wolfe said he had been drinking beer and bourbon with mates when he had to get away from an alcoholic acquaintance after an altercation and chose to get behind the wheel.

Magistrate Deborah Vasta acknowledged Wolfe’s extensive criminal history and noted his last drink drive offence had been in 2012.

Wolfe was fined $1,500 and disqualified from driving for four months.

A conviction was recorded.
