A couple in their sixties have been left terrified after a horticulturalist damaged property at and demanded entry to their residence while claiming to be a police officer during a bizarre early morning event.

Appearing at the Cleveland Magistrates Court on October 13 Logan Oberholzer, 21, pleaded guilty to commit public nuisance, obstruct police officer, trespass and wilful damage.

The court heard police responded to a home invasion call at 2.58am on September 12 at a Bertson Crescent property in Wellington Point to find Redland Bay man Oberholzer standing with a pot plant in hand with four others smashed on the driveway.

The prosecution said the defendant, who works in horticulture, was visibly drug affected on the morning, had smashed numerous pot plants and had impersonated a police officer.

The court heard Oberholzer had used the light from his mobile as a torch to shine into the property while yelling “open up I have a search warrant”.

The court was further told the terrified homeowners, both in their late sixties, witnessed the defendant throw six of their patio lawn chairs into their backyard.

The prosecution said once arrested, a rambling and uncooperative Oberholzer uttered a piercing screech for a minute, had to be restrained and was later taken to Redland Hospital.

Defence solicitor Kieran Smith said Oberholzer claimed to have been in an alcohol-induced psychosis on the morning, could recall nothing of the event and was disgusted with what he appreciated would have been a petrifying encounter for the homeowners whom he had never met before.

Oberholzer further told the court that he had a “very hectic childhood”, had been homeless since he was 12 years old and could no longer “go socialising” for fear of how he might react.

The defendant also said that he would gladly write a letter of apology to his victims.

However, the court would hear the frightening incident was one in a list of serious past offending – including unlawful use of a vehicle in 2018 and 2019 and wilful damage in February – that may put the defendant in range of a prison sentence should they continue.

“This would have been really terrifying,” magistrate Deborah Vasta said.

“Imagine if this was a house with young children.

“You are coming to the end of the road.”

Oberholzer was sentenced to two years’ probation and ordered to complete 60 hours of community service.

A conviction was recorded and an order was created barring Oberholzer from coming within 100 metres of the residence.
